Acceptance of Terms

By downloading, installing, or using Digital Memoirs, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the app.

Description of Service

Digital Memoirs is a memoir-writing application that helps you document your life stories through guided reflection questions, AI-assisted writing, and family collaboration features.

Account Registration

To use Digital Memoirs, you must sign in with your Apple ID. You are responsible for:

• Maintaining the security of your Apple ID

• All activity that occurs under your account

• Ensuring your account information is accurate

You must be at least 13 years old to use Digital Memoirs.

Your Content

Ownership

You retain full ownership of all content you create in Digital Memoirs, including your written responses, memoir chapters, and photos. We do not claim any ownership rights to your content.

License to Us

By using our service, you grant us a limited license to store, process, and transmit your content solely for the purpose of providing the service to you. This includes:

• Storing your data on our servers for backup and sync

• Sending your content to OpenAI for AI-assisted features

• Sharing your content with family members you explicitly invite

Content Guidelines

You agree not to use Digital Memoirs to:

• Upload content that is illegal, harmful, or violates others' rights

• Share content that infringes on intellectual property rights

• Harass, abuse, or harm other users

• Distribute malware or attempt to compromise the service

AI-Generated Content

Digital Memoirs uses artificial intelligence to generate questions and help write memoir chapters based on your responses.

You understand that:

• AI-generated content may contain errors or inaccuracies

• You are responsible for reviewing and editing AI-generated content

• AI-generated chapters are based on the information you provide

• The quality of AI output depends on the detail of your responses

You retain ownership of AI-generated content created from your responses.

Family Sharing & Collaboration

When you invite family members to collaborate:

• You control what content is shared and with whom

• You can set permissions (view, comment, or contribute)

• You can revoke access at any time

• Shared content may be viewed by all invited family members

You are responsible for:

• Only inviting people you trust

• Managing sharing permissions appropriately

• Content shared by family members in contributions and comments

Subscriptions & Payments

Free Tier

Digital Memoirs offers a free tier with limited features.

Premium Subscription

Premium features are available through in-app purchase subscriptions. By subscribing, you agree to:

• Pay the subscription fee displayed at the time of purchase

• Automatic renewal unless cancelled before the renewal date

• Apple's Terms and Conditions for in-app purchases

Cancellation

You may cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.

Price Changes

We reserve the right to change subscription prices. You will be notified of any price changes before they take effect.

Intellectual Property

Digital Memoirs and its original content, features, and functionality are owned by us and are protected by copyright, trademark, and other intellectual property laws.

You may not:

• Copy, modify, or distribute the app

• Reverse engineer or decompile the app

• Use our trademarks without permission

• Remove any copyright or proprietary notices

Service Availability

We strive to maintain reliable service but do not guarantee:

• Uninterrupted or error-free operation

• That defects will be corrected

• That the service will meet your specific requirements

We may:

• Modify or discontinue features with or without notice

• Perform maintenance that temporarily affects availability

• Suspend accounts that violate these terms

Limitation of Liability

To the maximum extent permitted by law:

• Digital Memoirs is provided "as is" without warranties of any kind

• We are not liable for any indirect, incidental, or consequential damages

• Our total liability shall not exceed the amount you paid for the service in the past 12 months

• We are not responsible for content created by users or AI

This does not affect your statutory rights as a consumer.

Indemnification

You agree to indemnify and hold harmless Digital Memoirs and its operators from any claims, damages, or expenses arising from:

• Your use of the service

• Your violation of these terms

• Your violation of any third-party rights

• Content you create or share through the service

Data & Privacy

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your information. By using Digital Memoirs, you consent to our data practices as described in the Privacy Policy.

Third-Party Services

Digital Memoirs integrates with third-party services including:

• Apple (authentication, payments, notifications)

• OpenAI (AI-powered features)

• Supabase (cloud storage and sync)

Your use of these services is subject to their respective terms and conditions.

Termination

We may terminate or suspend your account if you:

• Violate these Terms of Service

• Engage in fraudulent or illegal activity

• Abuse the service or other users

Upon termination:

• Your right to use the service ends immediately

• You may lose access to your cloud-synced data

• Local data on your device remains accessible

Changes to Terms

We may update these Terms of Service from time to time. We will notify you of significant changes through the app or via email. Continued use of the app after changes constitutes acceptance of the updated terms.

Governing Law

These terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.

Severability

If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
